1. Event Registration and Accounts

• Account Creation: To register for an event, you may be required to create a personal account on the Platform. You must provide accurate and complete information (such as your name, contact information, and age) during registration. You are responsible for maintaining the confidentiality of your account login and for all activities under your account.
• Platform Security and Acceptable Use: By using the Platform, you agree not to hack, disrupt, damage, or attempt to gain unauthorised access to our systems, servers, or networks. You agree not to transmit any viruses, malware, or harmful code. If you discover any vulnerabilities, bugs, or technical issues on the Platform, you agree to report them to us promptly so we can address them.
• Eligibility: Age limits may vary depending on the specific event. Unless an event explicitly imposes an age restriction, there is no general age limit; however, if you are under 18 years of age, a parent or legal guardian must register on your behalf and consent to these Terms. By registering, you represent that you are medically fit to participate in the event and have no medical condition that would make your participation unsafe.
• Event Organiser Terms: Each event may have its own rules, waiver, or terms set by the Organiser. You agree to review and comply with the event-specific terms in addition to these Platform Terms. In case of a conflict, these Terms will govern your relationship with us, while the Organiser's terms govern your participation in that specific event.
• Registration Confirmation: Your registration for an event is confirmed only after successful payment of the registration fee and issuance of a confirmation. We reserve the right to refuse or cancel a registration (with a refund of any payment) if eligibility criteria are not met or if there was an error in pricing or event information.
• Non-Transferable: Registrations are generally non-transferable to other persons or events, unless the Organiser explicitly allows transfers according to their policies. You agree not to sell or transfer your race entry without permission.

2. Fees, Payments and Refund Policy

• Payment Processing: All registration fees are quoted in the currency stated on the event page (typically Singapore Dollars, "SGD", unless otherwise specified). Payments are processed via our third-party payment gateway or service providers. By registering, you authorise us or our payment processors to charge your provided payment method.
• Third-Party Payment Providers: We use reputable payment processing services to handle your payment information. All transactions are encrypted and subject to the terms and privacy policies of the payment provider. We are not liable for any payment processing errors or security breaches arising from the payment provider, though we will reasonably assist in rectifying issues.
• Registration Fees and Taxes: Registration fees may include charges for participation, administration, and any goods or services expressly stated (such as race items or merchandise). Any applicable taxes (e.g., GST in Singapore) are included in the price unless stated otherwise.
• All Sales Final: Unless otherwise stated in the event's specific policy or required by law, all registrations are final and non-refundable. Once you have registered and paid for an event, you will not be entitled to a refund if you decide not to participate, cannot attend, or fail to complete the required distance.
• Event Cancellations and Changes: If an event is cancelled or significantly changed by the Organiser, the Organiser's refund or transfer policy will apply. The Platform will facilitate any refunds or credits authorised by the Organiser.
• Platform Fee: We do not charge Participants a separate fee for using the Platform beyond the registration fee, unless expressly stated.
• Refund Process: In cases where a refund is approved, it will be processed via the original payment method wherever possible. Transaction fees and payment processing fees may not be refundable.
• Chargebacks: You agree to contact us or the Organiser to resolve any payment disputes before initiating a chargeback with your card issuer. Unwarranted chargebacks may be considered fraudulent.

3. Virtual Event Participation and Result Submission

For virtual events (races that you complete at your chosen location and time within a stated period), you are strictly responsible for recording and submitting your results as per the event requirements:

• Assumption of Virtual Event Risks: By registering for a virtual event, you acknowledge that you run at your own risk. You are solely responsible for ensuring you are medically fit to complete the distance. You are solely responsible for selecting a safe route, adhering to traffic regulations, and following pedestrian safety rules. The Organiser and the Platform assume no liability for any injuries, accidents, or health issues sustained during a virtual activity.
• Health and Safety Advisory (Sports Safe): We strongly advise you to listen to your body at all times. Do not exercise if you are feeling unwell. We recommend monitoring your health vitals (such as heart rate, blood pressure, and oxygen levels) before and during the activity. Stop immediately and seek medical attention if you experience pain, severe discomfort, dizziness, or shortness of breath. Always consult a doctor before starting a new fitness challenge.
• Methods of Submission: Results can be submitted either (a) manually through the Platform by uploading required evidence, or (b) by syncing with a supported fitness tracking service like Strava.
• Third-Party APIs and Trackers: We hold no responsibility and cannot guarantee the stability, accuracy, uptime, or data syncing capabilities of any third-party APIs, fitness trackers, smartwatches, or external software (e.g., Strava, Apple Health, Garmin) used to record or submit your results. It is your responsibility to ensure your device accurately captures the required metrics.
• Submission Integrity & Verification: All submitted results are subject to rigorous review and verification, powered by our Heymetric™ engine. For manual submissions, the uploaded screenshot must clearly and legibly display both the completed distance in KM and the time duration of the activity.
• Rejection of Submissions: The Organiser reserves the absolute right to reject any activity submissions that appear falsified, inaccurate, duplicate, or fail to clearly display the mandatory distance (in KM) and duration metrics. Blatant data manipulation is strictly prohibited.
• Submission Deadline & Forfeiture: Each virtual event features a strict deadline by which all results must be submitted. The policy regarding uncompleted events depends on the specific event. For many of our virtual events, race items will be dispatched to you regardless of whether you fully complete the distance. However, certain challenges may strictly require completion to earn your entitlements. If you fail to achieve the required minimum distance (e.g., 6.1 KM) or fail to submit valid evidence before the deadline for a strict-completion event, your submission may be rejected, and you will forfeit your right to receive any race items. Always refer to the specific event's rules. No refunds will be provided for forfeited items.
• Platform Downtime near Deadlines: We strongly advise against submitting results at the last minute. The Organiser and the Platform are not liable for any failure to submit results due to technical issues, internet outages, or Platform downtime occurring near the submission deadline.

4. Physical Event Participation

For physical (in-person) events, the following additional terms apply:

• Event Day Procedures: You agree to follow all instructions and rules provided by the Organiser and race officials on the event day, including safety protocols, start times, and cut-off times.
• Race Bibs and Identification: You must wear any required bib or electronic timing device as instructed. You may be required to show government-issued photo identification when collecting your race materials.
• Race Item Collection: If the event provides race items prior to the race, you must collect them at the designated location and time(s). Any race items not collected as per the instructions may be forfeited without a refund, unless the Organiser provides alternative arrangements.
• Medical Attention: You consent to any medical attention deemed necessary by event medical staff. You are responsible for any medical costs incurred if not covered by the Organiser.
• Removal from Event: The Organiser or race officials reserve the right to remove you from the course or disqualify you if you are unable to continue safely, are endangering others, or have violated event rules.

5. Race Items and Certificates

• Race Items: Participants who successfully complete the race and meet all minimum distance requirements in accordance with the rules may receive race items (e.g., medals, apparel). These items are subject to availability and provided by the Organiser.
• Digital Certificates: Participants who meet the event's completion criteria will receive a digital electronic certificate.
• No Monetary Value: Race items, apparel, medals, and certificates have no cash value and cannot be exchanged for cash or refunds. Failing to claim or qualify for these items does not entitle you to financial compensation.

6. Race Item Delivery and Fulfilment

For virtual events where race items are physically delivered to participants:

• Shipping Details: You must provide a valid, complete, and accurate mailing address during registration. Additional shipping fees may apply if not included in the primary registration fee.
• No Office Collection: Please note that our registered office is an administrative facility. There is strictly no physical collection of race items at our office address under any circumstances. All items will be dispatched via courier or postal services.
• Transfer of Liability: Title and risk of loss for any physical goods pass to you the moment the items are handed over to the courier or postal service. The Organiser and the Platform are not responsible for race items that are lost, stolen, damaged, or delayed in transit once dispatched.
• Incorrect Addresses and Re-delivery: The Organiser is not liable for items returned or lost due to an incomplete or incorrect address provided by the participant. If a package is returned to the sender due to participant error or failure to collect, you will be responsible for any additional administrative and re-delivery fees. No refunds will be issued for race items that cannot be delivered due to participant error.
• International Delivery & Customs: Any overseas customs duties, import taxes, or clearance fees are strictly borne by the recipient (you). You are solely responsible for paying any applicable cross-border fees. The Organiser and the Platform are not liable for packages held or rejected by customs.

7. Participant Conduct, Data Privacy, and Content Rights

• Honesty and Integrity: You agree to participate fairly. The Organiser has the right to disqualify or ban participants for cheating, falsifying data, or engaging in harassment.
• Rights to Submitted Content (User-Generated Content): By submitting results, data, screenshots, images, videos, or any other media to the Platform, you grant Triple Wave Pte. Ltd. and the Organiser a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive licence to use, reproduce, modify, adapt, publish, and display such content. This grants us the 100% right to utilise your submitted data and media for data analysis, promotional marketing, social media campaigns, platform improvements, and any other commercial reasons without further compensation or notification to you.
• Personal Data and Privacy (PDPA): We will handle your personal data in compliance with Singapore's Personal Data Protection Act (PDPA) and our Privacy Policy. We share your registration information (name, contact details, apparel size, results) with the Organiser strictly for event administration and fulfilment purposes.
• WhatsApp, SMS, and Marketing Consent: By providing your mobile telephone number during registration, you explicitly consent to receive communications via SMS and third-party messaging platforms (including, but not limited to, the WhatsApp Business API and Meta Cloud API).
  • Transactional Messages: You agree to receive essential, non-promotional messages related to your participation, such as registration confirmations, submission reminders, and courier shipping updates.
  • Promotional Messages: You consent to receive marketing and promotional broadcasts regarding future events, challenges, and platform updates.
  • Opt-Out Mechanism: You may withdraw your consent for promotional broadcast messages at any time by following the opt-out instructions provided within the message (e.g., replying "STOP") or by contacting our support team. Opting out of promotional messages will not prevent you from receiving essential transactional updates for an active event.

8. Limitation of Liability and Disclaimers

• Platform Role: Triple Wave Pte. Ltd. acts as an intermediary technology platform. We do not organise the events (unless explicitly stated). We do not assume responsibility for the Organiser's obligations, event quality, safety, or fulfilment of race items.
• Liability for Personal Injury: To the maximum extent permitted by law, neither we nor the Organiser will be liable for any injury, illness, or death you may suffer as a result of your participation in an event. You participate entirely at your own risk.
• Liability for Property Damage or Loss: We and the Organiser are not responsible for any loss or damage to your personal property, equipment, or data arising from event participation or Platform use.
• No Liability for Indirect Damages: In no event will we be liable for any indirect, incidental, consequential, special, or punitive damages (including lost profits or travel expenses), even if advised of the possibility of such damages.
• Cap on Liability: Our total aggregate liability to you for any claims relating to your use of the Platform or event participation is strictly limited to the amount of the registration fees paid by you for that specific event.
• Indemnity: You agree to indemnify and hold harmless Triple Wave Pte. Ltd. (and its directors, officers, and employees) from any claims, liabilities, damages, or legal fees arising from your breach of these Terms, your negligence, or any third-party claims arising from your actions.

9. Governing Law and Dispute Resolution

• Governing Law: These Terms are governed by the laws of the Republic of Singapore.
• Jurisdiction: Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
• Disputes with Organisers: Any disputes relating to the event itself (such as injuries, event quality, or race item fulfilment) are strictly between you and the Organiser. The Platform is not obligated to resolve such disputes.

10. Other Provisions

• Changes to Terms: We may update these Terms from time to time. Continued use of the Platform after changes constitutes your acceptance of the revised Terms.
• Severability: If any provision is found to be invalid by a court, the remainder of the Terms shall remain in full force and effect.
• Entire Agreement: These Terms, our Privacy Policy, and any event-specific rules constitute the entire agreement between you and Triple Wave Pte. Ltd.
